By accessing and using OpenAkiya, you agree to be bound by these Terms & Conditions. If you do not agree, please do not use our service.
1. About the Service
OpenAkiya is a property directory and information connector operated by Snapscribe Ltd, a company registered in Cyprus. OpenAkiya aggregates publicly available vacant home (akiya) listings from Japanese municipal government akiya banks and presents them in a translated, searchable format for international audiences.
OpenAkiya is strictly a directory and information connector. We are not a real estate agency, broker, dealer, or legal adviser. We do not sell, buy, lease, manage, or broker any property. We do not participate in, facilitate, intermediate, or guarantee any property transaction. We do not own any of the listed properties. We simply aggregate publicly available data from Japanese municipal sources, translate it, and connect interested individuals with the official sources. Any decision to purchase, visit, or inquire about a property in Japan is made entirely at your own risk and responsibility.
2. Disclaimer of Accuracy
We make every reasonable effort to source accurate and up-to-date property information from official Japanese municipal akiya banks and government sources. However:
- We do not guarantee the accuracy, completeness, or currency of any property listing, price, description, photograph, measurement, or other information displayed on OpenAkiya.
- Property data may be outdated. Listings may have been sold, withdrawn, or modified by the original source without notice to us.
- Translations are approximate. Property descriptions are translated from Japanese for convenience. Translations may contain errors or lose nuances present in the original text.
- Currency conversions are approximate. USD prices shown alongside JPY prices are indicative only and may not reflect the actual exchange rate at the time of purchase.
- Photographs and measurements are provided by municipal sources and have not been independently verified by Snapscribe Ltd.
You must independently verify all property information before making any purchase decision. We strongly recommend engaging a qualified Japanese real estate professional, legal adviser, and/or surveyor before proceeding with any property transaction.
3. No Liability for Property Transactions
OpenAkiya is a connector — we display publicly available information and allow users to express interest. We have no role in any transaction that may follow. Snapscribe Ltd and OpenAkiya shall not be held liable for:
- Any loss, damage, cost, or expense arising from reliance on information displayed on OpenAkiya
- Any property transaction, negotiation, or decision made based on our listings
- The condition, legal status, structural integrity, or suitability of any listed property
- Any dispute between buyers, sellers, agents, municipalities, or any other parties involved in a property transaction
- Changes in property availability, pricing, or status after information is published on our platform
- Any issues related to property ownership rights, zoning, building regulations, environmental concerns, or hidden defects
- Any actions taken by third parties (including real estate agents, municipal offices, or legal advisers) that you contact as a result of using OpenAkiya
- Any immigration, visa, tax, or legal consequences of purchasing property in Japan
4. Data Sources
Property listings on OpenAkiya are sourced from publicly available Japanese municipal akiya bank databases. These databases are maintained by local Japanese governments and are the authoritative source for the listed properties. OpenAkiya is an independent service and is not affiliated with, endorsed by, or connected to any Japanese government entity, municipality, or official body.
5. Inquiry Forms
When you submit an inquiry about a property through OpenAkiya:
- Your inquiry is recorded by OpenAkiya and may be forwarded to relevant contacts who can assist with the property
- Submitting an inquiry does not constitute a binding offer, reservation, commitment, or contract of any kind
- We do not guarantee a response to your inquiry or a specific response time
- OpenAkiya acts solely as a communication channel — we do not negotiate, mediate, or participate in any discussions that may follow from your inquiry
- Your contact details will be handled in accordance with our Privacy Policy
6. Membership & Payments
Membership is a subscription to our directory and information service. You are paying for access to curated, translated property data — not for any property itself.
- Membership provides access to the full property directory, including unrestricted browsing, property details, and the ability to save listings and submit inquiries.
- Lifetime Access ($49) is a one-time payment for permanent access to the platform as it exists. We reserve the right to modify features over time.
- Yearly Access ($99/year) renews annually unless cancelled. You may cancel at any time before the renewal date.
- Payments are processed securely by Stripe. Snapscribe Ltd does not store your payment card details.
- Refunds: Given the immediate nature of digital access, refunds are assessed on a case-by-case basis. Contact us within 14 days of purchase if you are unsatisfied.
7. Acceptable Use
You agree not to:
- Scrape, copy, or systematically download property listings or data from OpenAkiya
- Use OpenAkiya data to create a competing service
- Submit false or misleading information through inquiry forms
- Attempt to gain unauthorised access to other users' accounts or our systems
- Use the service for any unlawful purpose
8. Intellectual Property
The OpenAkiya name, logo, website design, and original content are the property of Snapscribe Ltd. Property photographs and descriptions are sourced from public municipal databases and remain the property of their respective owners. You may not reproduce, distribute, or commercially exploit any content from OpenAkiya without our written permission.
9. Third-Party Links & Services
OpenAkiya may contain links to third-party websites, including virtual reality tours (e.g., Spacely.co), maps (OpenStreetMap), and payment processors (Stripe). We are not responsible for the content, privacy practices, or availability of any third-party services.
10. Limitation of Liability
To the maximum extent permitted by law, Snapscribe Ltd's total liability to you for any claim arising from your use of OpenAkiya shall not exceed the amount you paid for your membership. In no event shall Snapscribe Ltd be liable for any indirect, incidental, special, consequential, or punitive damages.
11. Indemnification
You agree to indemnify and hold harmless Snapscribe Ltd, its directors, employees, and agents from any claim, loss, or damage arising from your use of OpenAkiya, your breach of these terms, any property transaction you enter into based on information found on OpenAkiya, or any communication with third parties initiated through our platform.
12. Governing Law
These Terms & Conditions are governed by and construed in accordance with the laws of the Republic of Cyprus. Any disputes arising from these terms or your use of OpenAkiya shall be subject to the exclusive jurisdiction of the courts of Cyprus.
13. Changes to These Terms
We may update these Terms & Conditions from time to time. Continued use of OpenAkiya after changes are posted constitutes your acceptance of the updated terms. We will notify registered users of material changes via email.
